How to file a complaint with your State Insurance Department

There are many reasons why you may want to file a complaint with your State Insurance Department and Commissioner. If you have experienced problems with your Insurance Agent, Insurance Company or regarding a specific policy then you should contact your State Insurance Department and file a formal complaint. Before filing a complaint try to resolve the issue with them. Contact your Insurance Agent and Insurance Company and supply them with your data. Be sure that you have fully read and understand your Insurance policy before contacting them. Understanding your policy is the best way to limit issues dealing with claims. If you have tried to resolve the issue with your Insurance company and your confident your data is factual and your Insurance Company has not fairly reviewed your claim then file a complaint.

Filing a complaint with your Insurance Department is easy and though every state is different they all review your complaint to see if an Insurance Law has been broken. Each state has it's unique set of Insurance Laws and the Department will determine if any of these laws have been broken. The State Insurance Department will then contact your Insurance Agent or Company and ask for a response to the complaint. The idea here is that the Department wants a fair exchange of information before they decide who is at fault. If the State Insurance Department finds that your complaint is valid they will ask the Insurance Company to rectify the situation and perform a full investigation. If your complaint is not valid then your Insurance Department will let you know why it is not valid. Either way, it can take up to two months to process a complaint and once again please note that this is a very basic description of the process. Each state is different and each process is different.
